MINUTES OF THE MEETING
May 18, 2010

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, May 18, 2010 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Evelyn Strawn, Chairperson, Gerre Hooker, Vice-Chairman and Commissioners James Aimone, Brooke Monroe. John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.


7:00 P.M.       Public Hearings Begin

7:00 PM The Plymouth Conservation Commission will hold a Public Hearing in the Plantation Conference Room, 2nd floor, 11 Lincoln Street, Plymouth, Massachusetts on Tuesday, May 18, 2010, at 7:00 PM, to modify its Rules and Regulations for Plymouth Wetlands Protection Bylaw, by deleting Section 13 entitled EXEMPTIONS, as they relate to alterations of land in connection with existing single family and two-family dwellings (residences) and additions thereto on any lot of record as of the effective date of these Rules and Regulations (April 23, 1990), provided such impact to a wetland resource is otherwise lawful under Massachusetts General Law Chapter 131, Section 40, as amended.  This Exemption does not authorize so called “clear cutting” or the removal of vegetation in a wetland resource area, or the buffer, thereto.

Evelyn Strawn spoke regarding what has lead up to making the necessary changes to the Rules and Regs .

Public Comment:
Randy Parker – commented on why Section 13 was parts of the Regs.
Lenore White, the Commission’s consultant – stated that the newly drafted regs are in accordance with the surrounding towns wetland bylaws and regs.
Mark Flaherty – spoke about the 25 ft. no build areas and how it would affect projects.  
No further public comment.
James Aimone motioned to eliminate Section 13 of the Exemptions - Approved unanimously.

7:30 PM Linda J. Pinto, 99 Lake Drive, Parcel ID No. 130-002-000D-157.  A Request for Determination of Applicability to upgrade the existing septic system in the buffer zone of Mare Pond aka Honey Pot Lake.
Liz Sullivan represented the applicant.  Project is 98.9 feet into the buffer zone.
Gerre Hooker motioned to issue a negative determination.  Ms. Monroe abstained.  Approved by a majority.

7:35 PM Cordage Development, LLC, 10 Cordage Park Circle, Parcel ID No. 001-000-001D-000.  A Request to Amend the Order of Conditions for DEP File No. SE57-2275 to allow for the construction of a floating tire wave attenuation system in Plymouth Harbor in order to protect the existing floating dock system.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA and Division of Marine Fisheries.
Joe Forns of Applied Marine Ecology Lab.  
He noted that NHESP has responded with no negative impact.  
An extension permit is also requested.  Joe explains the tire system, 4-5 diameter, floating system, chain linked together.  These are seasonally installed while the seasonal marina is in use.  Chapter 91 license will be amended if necessary.  

No Public Comment made:
Mr. Withington motioned to amend the OOC to include the wave attenuators..  Approved unanimously.

7:40 PM Michael D. Hatton, 163 Black Cat Road, Parcel ID No. 090-000-024-000.  A Notice of Intent to construct a detached two-story 2-car garage, including grading, in the buffer zone of an abandoned cranberry bog.
Mark Flaherty of Flaherty and Stefani represented the applicant and explained the project
No public comment made.
Gerre Hooker motioned to approve with conditions.  Approved unanimously.

7:50 PM Carl G. Cederquist, Saquish Beach, Parcel ID No. 132-000B-499-000.  A Notice of Intent to demolish a portion of the existing cottage, shed and deck, and construct a new deck, roof deck with stairs and new deck floor on an existing deck, in the resource of coastal dune system and marsh on Saquish Beach.
Mark Flaherty of Flaherty and Stefani represented the applicant and explained the project.  Mark Flaherty reviewed the FEMA regulations for the new construction.  All disturbed areas will be restored with beach grass.  
All construction will conform with FEMA building guidelines.
Gerre Hooker motioned to approve the project with conditions.  Approved unanimously.

8:00 PM         Jewel Trust/Jeffrey S. & Elizabeth H. Wallace Trustees, 131 West Long Pond Road, Parcel ID No. 069-000-026-000.  A Notice of Intent to demolish the existing single family dwelling and construct a new single family dwelling, including utilities and amenities, driveway and grading, in the buffer zone of Long Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
John Scagliarini recused himself from the hearing.

Mark Flaherty of FS represented the applicant and explained the dwelling reconstruction.  Mark gave history of the renovation of the boathouse and the “red’ house.  Hundreds of plantings have been added to the property.  ZBA approval has been granted   7 trees will need to be removed within and outside of the buffer zone.  Drainage was the biggest concern in the engineering of the site.  Rain gardens are proposed.  Closest point of house to dwelling is 49 feet.  
Mr. Wallace showed and explained the various architectural sketches of the proposed dwelling.

Mr. Wallace stated that his goal in tree removal is for every one tree removed 3 trees will be planted.

Public Comment:
137 West Long Pond Road – Ernie Opan
Conditions to establish greens on the west bound side.  Concern with water runoff in this area and compatible silt fence.  Silt socks can be used also.

Other Business:

CERTIFICATE OF COMPLIANCE:
Michael DiTullio (formerly Gary Mole), 116 Warren Avenue, SE57-2400- for pool and bridge.  James Aimone motioned to approve COC.  Approved unanimously.
Ellen Cavicchi, 154 Warren Avenue, SE57-1850 for dwelling reconstruction.  John Scagliarini motioned to approve COC.  Approved unanimously.

EXTENSION PERMIT:
Cordage Development LLC, 10 Cordage Park Circle, SE57-2275.  Approved unanimously.
Gerre Hooker motioned to issue a 3-year extension.  Approved unanimously.

ORDERS OF CONDITIONS:
Cordage Development LLC, SE57-2275 (Amended OOC).  Gerre Hooker motioned to approved as presented.  Approved unanimously.

Jewel Trust, 131 West Long Pond Road, SE57-2479.  Gerre Hooker motioned to approve as written.  Approved unanimously.

Carl Cederquist, Saquish Beach, SE57-2484.  Gerre Hooker motioned to approve as written.  Approved unanimously.

Michael Hatton, 163 Black Cat Road, SE57-2482.  John Scagliarini motioned to approve as written.  Approved unanimously.

MISCELLANEOUS:
The Commission reviewed and approved a letter drafted for  Long, Gallagher, Lanney and Martin regarding well installations on Saquish Beach.  The letter clarified the Commission’s position on the use of the fire protection wells.
